Terms & Conditions

Complete terms and conditions governing the contractual relationship between you and Digital Claims Services Limited across every service, channel and deliverable.

Acceptance of Terms

1.1By accessing the Digital Claims Services Limited website ("Site") or engaging with any element of our Terms & Conditions, you agree to be bound by the provisions set out in this document. If you do not agree, you must cease use of the Site immediately.
1.2This document constitutes a legally binding statement between you ("User", "Client", "you") and Digital Claims Services Limited ("Digital Claims", "we", "us", "our"), a company registered in England & Wales under number 08948101.
1.3We reserve the right to amend the Terms & Conditions at any time. Continued use of the Site following any changes constitutes acceptance of the revised version. Material changes will be notified via email or by prominent Site notice.
1.4You are responsible for reviewing this document periodically. The "Last updated" date indicates when the Terms & Conditions was last revised by our Compliance Office.

Definitions

2.1"Services" refers to the financial documentation organisation, mapping, structuring, and clarity services provided by Digital Claims Services Limited, including all administrative and informational outputs.
2.2"Content" refers to all text, data, images, graphics, templates, methodologies and other materials displayed on the Site or delivered under the Terms & Conditions.
2.3"Client Materials" refers to documents, records, statements, correspondence and information you provide to us for the purpose of delivering our Services.
2.4"Deliverables" refers to the structured reports, summaries, indices, matrices, visualisations and documentation produced by Digital Claims as a result of our Services.

Fees and Payment

3.1Our fees are fixed and disclosed in writing before any engagement begins. No work will commence until you have agreed to the applicable fees in writing via the service agreement or engagement letter.
3.2Payment terms, methods and schedules will be set out in your individual service agreement. We accept payment by bank transfer, credit card and other methods specified at the time of engagement.
3.3All fees are quoted in British Pounds Sterling (GBP) unless otherwise stated. Fees are exclusive of VAT where applicable. VAT will be applied at the prevailing rate and itemised separately on invoices.
3.4Late payments may incur interest at the rate of 2% per annum above the Bank of England base rate, calculated daily from the due date until payment is received in full, plus reasonable recovery costs.

Service Delivery

4.1We will use reasonable endeavours to deliver our Services within the timeframes communicated to you. However, delivery times are estimates only and are not guaranteed unless expressly stated in the service agreement.
4.2Delays may occur due to factors outside our control, including delays by third-party institutions, incomplete Client Materials, regulatory requirements or Force Majeure Events.
4.3We will keep you informed of any material delays and provide revised estimates where practicable. You may request a status update at any time by contacting your assigned Case Manager.
4.4You acknowledge that the quality and completeness of our Deliverables depend in part on the accuracy, completeness and timeliness of the Client Materials you provide to us.

Intellectual Property

5.1All intellectual property rights in the Site, its Content and our proprietary methodologies, templates, classification systems and processes remain the exclusive property of Digital Claims Services Limited.
5.2You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Site for personal, non-commercial purposes in accordance with the Terms & Conditions.
5.3Deliverables produced for you are for your personal use only and may not be reproduced, distributed, sublicensed or commercially exploited without our prior written consent.
5.4You retain all ownership rights in your Client Materials. By providing Client Materials to us you grant a limited licence to use them solely for the purpose of delivering our Services during the engagement period.

Confidentiality

6.1We treat all Client Materials and personal information as strictly confidential and will not disclose them to third parties except as required by law, court order, or as set out in our Privacy Policy.
6.2Our staff and contractors are bound by confidentiality obligations through employment contracts and non-disclosure agreements and are trained in data handling and information security best practices.
6.3You agree to treat any proprietary information, methodologies, classification frameworks or processes shared by Digital Claims as confidential and not to disclose them to any third party without our written consent.
6.4Confidentiality obligations survive the termination of the Terms & Conditions and any service agreement for a period of five (5) years from the date of termination or expiry, whichever is later.

Data Protection

7.1We process personal data in accordance with our Privacy Policy, the UK General Data Protection Regulation (UK GDPR), the EU General Data Protection Regulation (EU GDPR) and the Data Protection Act 2018.
7.2You have the right to access, rectify, erase, restrict processing of, or port your personal data as set out in our Privacy Policy. Requests will be processed within 30 calendar days of receipt.
7.3We have appointed a Data Protection Officer (DPO) who can be contacted at legal@dc-service.uk for any data protection enquiries, subject access requests or complaints regarding data handling.
7.4In the event of a data breach affecting your personal data, we will notify you and the Information Commissioner's Office (ICO) within 72 hours in accordance with applicable data protection legislation.

Limitation of Liability

8.1To the maximum extent permitted by law, Digital Claims shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from or relating to the Terms & Conditions.
8.2Our total aggregate liability under or in connection with the Terms & Conditions shall not exceed the total fees paid by you for the specific Services giving rise to the claim in the twelve (12) months preceding the claim.
8.3We do not warrant that the Site will be uninterrupted, error-free or free of viruses. You are responsible for implementing sufficient procedures to satisfy your data security requirements.
8.4Nothing in the Terms & Conditions excludes or limits our liability for death or personal injury caused by our negligence, fraud, fraudulent misrepresentation or any other liability that cannot be excluded by applicable law.

Disclaimers

9.1The Site and Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory or otherwise, to the fullest extent permitted by law.
9.2We disclaim all implied warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement and accuracy of informational content.
9.3We do not guarantee the accuracy, completeness or timeliness of any information provided through the Site or our Services to the extent it depends on third-party sources or Client Materials.
9.4Any reliance you place on information obtained through the Terms & Conditions is at your own risk. Digital Claims is not responsible for decisions you make based on our Deliverables.

Indemnification

10.1You agree to indemnify, defend and hold harmless Digital Claims, its partners, employees, contractors and agents from and against any claims, liabilities, damages, losses and expenses arising from your use of the Services.
10.2This indemnification includes reasonable legal fees, court costs and expenses arising from your breach of the Terms & Conditions or any representation or warranty made herein.
10.3This indemnification extends to any inaccurate, misleading, incomplete or fraudulent information provided by you as Client Materials, and any resulting loss suffered by Digital Claims or third parties.
10.4Our right to indemnification under this clause shall survive the termination of the Terms & Conditions and any service agreement indefinitely.

Termination

11.1You may terminate your engagement with us at any time by providing written notice to info@dc-service.uk, subject to the terms of your service agreement.
11.2We may terminate or suspend your access to the Site or Services immediately, without prior notice or liability, if you breach any material provision of the Terms & Conditions.
11.3Upon termination, your right to use the Site and Services ceases immediately. Provisions that by their nature should survive termination (including confidentiality, liability, indemnification and dispute resolution) shall do so.
11.4Following termination, we will retain your Client Materials and Deliverables for a period of seven (7) years in accordance with our data retention policy, after which they will be securely destroyed unless you request earlier deletion.

Cancellation and Refunds

12.1Cancellation and refund terms are governed by our separate Cancellation Policy and Refund Policy, which form part of the Terms & Conditions and are available on our Site.
12.2Where applicable, you have a 14-day cooling-off period under the Consumer Contracts Regulations 2013 during which you may cancel without charge, provided Services have not yet commenced at your express request.
12.3If Services have commenced within the cooling-off period at your request, you may be required to pay a proportionate amount for Services already delivered, calculated on a pro-rata basis.
12.4Refund requests must be submitted in writing to info@dc-service.uk. Refunds are processed within 14 business days of approval.

Force Majeure

13.1Neither party shall be liable for failure or delay in performing obligations under the Terms & Conditions if such failure results from circumstances beyond reasonable control ("Force Majeure Event").
13.2Force Majeure Events include natural disasters, pandemics, war, armed conflict, terrorism, civil unrest, government actions, sanctions, power failures, internet disruptions and cyberattacks.
13.3The affected party shall notify the other party promptly of the Force Majeure Event, its expected duration and the obligations affected, and shall use reasonable endeavours to mitigate its effects.
13.4If a Force Majeure Event continues for more than ninety (90) consecutive days, either party may terminate the Terms & Conditions by giving fourteen (14) days' written notice.

Third-Party Links and Resources

14.1The Site may contain links to third-party websites, services or resources that are not owned, operated or controlled by Digital Claims Services Limited. Such links are provided for informational convenience only.
14.2We have no control over, and assume no responsibility for, the content, privacy policies, practices, accuracy or opinions expressed on any third-party websites linked from our Site.
14.3The inclusion of a link does not imply endorsement, sponsorship or recommendation by Digital Claims of the linked website, its operators or any products or services offered therein.
14.4You access third-party websites at your own risk and subject to their terms and conditions. We recommend reviewing third-party privacy policies before providing any personal information.

Prohibited Uses

15.1You may not use the Site or Services for any purpose that is unlawful or prohibited by the Terms & Conditions, including attempting to gain unauthorised access to our systems, networks or databases.
15.2You may not use automated scripts, bots, crawlers, scrapers or similar tools to access, index, scrape or interact with the Site without our prior written consent.
15.3You may not transmit any viruses, malware, worms, trojans or other harmful code through the Site, our communication channels or any document submission mechanism.
15.4You may not impersonate any person or entity, or falsely state or misrepresent your affiliation, or use another person's identity to access our Services.

Dispute Resolution

16.1In the event of any dispute arising from or relating to the Terms & Conditions, the parties agree to first attempt to resolve the matter through informal negotiation in good faith for not less than thirty (30) days.
16.2If the dispute cannot be resolved through negotiation within 30 days, either party may refer the matter to mediation under the rules of the Centre for Effective Dispute Resolution (CEDR). Costs of mediation shall be shared equally.
16.3If mediation fails to resolve the dispute within sixty (60) days of referral, either party may pursue legal proceedings in the courts of England & Wales, subject to the governing law provisions below.
16.4Nothing in this clause prevents either party from seeking urgent injunctive or equitable relief from any court of competent jurisdiction to prevent irreparable harm pending resolution of the dispute.

Complaints Procedure

17.1If you are dissatisfied with any aspect of our Services, please contact us at support@dc-service.uk with full details of your complaint, including your service reference number and supporting documentation.
17.2We will acknowledge your complaint within five (5) working days and assign a dedicated Case Manager. We aim to provide a full written response within twenty (20) working days of acknowledgement.
17.3If you remain dissatisfied after our internal complaints process, you may file a formal appeal within fourteen (14) calendar days of receiving our decision. Appeals are reviewed by a Senior Review Officer independent of the original case.
17.4If the appeal outcome remains unsatisfactory, you may escalate to the relevant UK dispute resolution body or pursue external mediation/arbitration within six (6) months of the final appeal decision.

Governing Law and Jurisdiction

18.1The Terms & Conditions shall be governed by and construed in accordance with the laws of England & Wales and the United Kingdom, without regard to conflict of law principles.
18.2The courts of England & Wales shall have exclusive jurisdiction over any dispute arising from or relating to the Terms & Conditions, subject to the dispute resolution provisions set out above.
18.3If any provision of the Terms & Conditions is found to be invalid, illegal or unenforceable, the remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary.
18.4The failure of Digital Claims to enforce any right or provision at any time shall not constitute a waiver of such right or provision and shall not affect the right to enforce such provision at a later time.

Entire Agreement

19.1The Terms & Conditions, together with our Privacy Policy, Cookie Policy, GDPR Compliance Policy and any individual service agreement, constitutes the entire agreement between you and Digital Claims regarding the use of our Site and Services.
19.2No oral or written representation, warranty, promise or statement not contained in the Terms & Conditions shall form part of the agreement between us, unless expressly agreed in writing by an authorised representative.
19.3In the event of a conflict between the Terms & Conditions and any individual service agreement, the service agreement shall prevail to the extent of the inconsistency, unless the Terms & Conditions expressly states otherwise.
19.4Any waiver of any provision must be in writing and signed by an authorised representative of Digital Claims. A waiver of one breach does not constitute a waiver of any subsequent breach.

Assignment and Transfer

20.1You may not assign, transfer, sub-contract or delegate any of your rights or obligations under the Terms & Conditions without our prior written consent. Any attempted assignment without consent shall be void.
20.2We may assign or transfer our rights and obligations under the Terms & Conditions to any successor entity, affiliate or as part of a merger, acquisition, corporate reorganisation or sale of all or substantially all assets.
20.3Any purported assignment or transfer in violation of this clause shall be null and void and shall not relieve the assigning party of any obligations under the Terms & Conditions.
20.4The Terms & Conditions shall be binding upon and inure to the benefit of the parties and their respective heirs, executors, administrators, successors and permitted assigns.

Electronic Communications

21.1By using our Site and Services you consent to receive communications from us electronically, including emails, notifications, secure messages and notices posted on our Site or client portal.
21.2You agree that all agreements, notices, disclosures and other communications provided electronically satisfy any legal requirement that such communications be in writing under applicable law.
21.3We may communicate service updates, policy changes, security alerts and important notices via email to the address you provide. You are responsible for ensuring your contact details are current.
21.4Electronic communications are not entirely secure and may be intercepted by third parties. Sensitive information should be shared through our secure document upload system.

Accessibility and Equal Access

22.1We are committed to making our Site and Services accessible to all users, including those with disabilities, in compliance with the Equality Act 2010, the European Accessibility Act and WCAG 2.1 Level AA standards.
22.2If you require information in an alternative format (large print, audio, Braille) or need reasonable adjustments to access our Services, please contact us at office@dc-service.uk.
22.3We regularly review our digital accessibility standards and implement improvements to ensure compliance with evolving best practices and legal requirements across all jurisdictions in which we operate.
22.4Feedback on accessibility issues is welcomed and will be addressed as a priority within our development cycle. We aim to resolve accessibility complaints within ten (10) working days of receipt.

Final Provisions

24.1The headings and clause numbers in the Terms & Conditions are for convenience of reference only and shall not affect their interpretation or construction.
24.2Unless the context otherwise requires, words in the singular shall include the plural and vice versa, and references to one gender shall include all genders.
24.3A person who is not a party to the Terms & Conditions shall not have any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any provision of the Terms & Conditions.
24.4The Terms & Conditions was last reviewed in February 2026 and is published at www.DC-Service.uk. The next scheduled review is February 2027.
